Routes to Patent Protection in Turkey
Patent protection in Turkey can be obtained through several filing routes, depending on whether the applicant is filing directly in Turkey or extending an international or European patent application. The entry routes are:
- National Patent Application in Turkey
- PCT National Phase Entry in Turkey
- Utility Model Protection in Turkey
- European Patent Validation in Turkey
Patent or Utility Model Protection in Turkey?
Turkey provides two principal forms of protection for technical inventions: patents and utility models. A patent may provide protection for up to 20 years, while a utility model may provide protection for up to 10 years.
The appropriate form of protection depends on the subject matter of the invention and the applicable patentability requirements. Patent applications are subject to substantive examination, including assessment of inventive step. Utility models follow a different procedure in which inventive step is not examined, although novelty and industrial applicability are still required. Certain subject matter, including processes, cannot be protected by a utility model in Turkey.
For further information, see our Utility Model Protection in Turkey page.
Patent Protection for Foreign Applicants in Turkey
Foreign applicants seeking patent protection in Turkey should select the filing route according to the status of their existing patent application. An applicant may file directly in Turkey and claim priority from an earlier foreign application, enter the Turkish national phase of a PCT application, or validate a European patent granted by the EPO.
The appropriate route affects the applicable deadlines, translation requirements and procedural steps before TÜRKPATENT. Foreign applicants who do not have a residence in Turkey generally conduct patent proceedings through an authorized Turkish patent attorney.
For international applicants, reviewing the filing route and relevant deadlines before taking action in Turkey can help avoid unnecessary costs and loss of rights.
